QUETTA – In a significant judicial intervention, the Balochistan High Court (BHC) on Monday ordered the immediate removal of the Chairman of the Balochistan Development Authority (BDA), declaring his appointment a violation of the law.
The Judicial Bench and Ruling
A divisional bench comprising Chief Justice Muhammad Kamran Khan Mulakhail and Justice Najamuddin Mengal presided over the hearing. The court issued a 24-hour ultimatum for the Chairman to vacate his office and return all official perks and privileges.
Court Remarks on Governance and NAB Inquiries
The bench expressed strong dissatisfaction with the appointment process, labeling it an "illegal act." The court’s observations included:
Lack of Merit: The bench remarked that such appointments are "not commendable" and undermine administrative integrity.
Legal Scrutiny: It was noted during the proceedings that the removed Chairman is currently facing multiple inquiries by the National Accountability Bureau (NAB).
Order for New Appointment
The High Court has directed the Provincial Government of Balochistan to initiate a fresh recruitment process. The government must appoint a new Chairman in strict accordance with the law and merit-based criteria.
